MARRIAGE REQUIRMENTS FOR MINORS

How Minors Can Legally Obtain a Marriage License in New York

In the state of New York, competent individuals who are 18 years of age and older may acquire a marriage license and do not need to obtain the consent of any other individual in order to do so. For those individuals who are under the age of 18 there are some instances these types of people may be able to obtain a marriage license and legally be wed providing that certain requirements be met. The following paragraphs will highlight how individuals under the age of 18 can be legally married in the state of New York.

Individuals 16 or 17 Years of Age

For those young men and young women who are just one or two years shy of the age of majority, there are ways for these individuals to legally obtain a marriage license in New York. Any individual who is 16 or 17 years of age and wishes to get married must obtain the written consent of both of their parents prior to being able to obtain a marriage certificate. There are certain circumstances where written consent by one parent alone is valid such as in the case where the other parent has been missing for one year before the request for consent was made, the one parent has sole custody or the other parent has been deemed incompetent or is deceased.

Individuals 14 or 15 Years of Age

For those individuals who are only 14 or 15 at the time of the request for a marriage license, they must present both the written consent of both parents and the decree of a justice of the Supreme Court or Family Court judge within the town of application request.

Individuals under the Age of 14

For those individuals that are under the age of 14, it is under no circumstances that a marriage license will be issued to those individuals in the State of New York. This is a way of the state saying children 13 years of age and younger should not have the ability to be married for any reason. There are valid reasons behind doing so and it can arguably be said that this rule is not an unfair one.

The previously mentioned items are a few ways in which individuals who are under the age of majority may legally and validly obtain a marriage license in New York.
