Previous Marriages and Obtaining a Marriage License in New York

Those individuals who are looking to be married in the state of New York and are about to be married for the second time, may wonder what type of restrictions and procedures they should be aware of prior to obtaining their marriage license. Must Be Divorced

The title of the document will vary depending upon the state in which the first marriage/dissolution was acquired; however, it is usually entitled as Decree of Divorce or Dissolution of Marriage. It is crucial that the previously married individual makes this document available to the town/city clerk. If one is unsure as to what documents are needed, the best way to find out is to call the town clerk or visit the town website to determine what documents they have to bring with them.

Obtain Documents in Advance

Perhaps the most important piece of advice one should take into consideration with regard to obtaining a marriage license for a second marriage is to take care of the divorce issues and documents in advance. As the court system tends to experience high volumes at times, it is important that any issues regarding a prior dissolution of marriage are tended to way in advance of the second marriage. This will help to ensure that the marriage ceremony preparations progress smoothly.
