(Long Island, NY) Garden City detectives report the arrest of an Amityville man for an occupied burglary that occurred in Garden City on Wednesday, June 10, 2015 at 3:00 A.M.
According to detectives, Nervon Gayles, 20, entered a home on Third St., through an unlocked rear door, while the residents were asleep on the second floor. The defendant took electronics and cell phones and left the scene. Garden City detectives along with Nassau County Third Squad detectives located the defendant through the cell phone location application in Hempstead, where he was placed under arrest at 12:55 P.M. The proceeds from the burglary were recovered.

No injuries were reported.
Gayles is being charged with Burglary 2nd Degree, Criminal Possession Stolen Property 4th Degree and will be arraigned on Thursday, 06/11/15 in First District Court, Hempstead.
The fact that a defendant has been charged with a crime is merely an accusation and the defendant is presumed innocent unless proven guilty. Defendants are entitled to a fair trial with the burden on the prosecution to prove guilt beyond a reasonable doubt.
