The officers were able to secure the defendant despite family members who exited the house attempting to aid the defendant and video the incident. The injured officer was transported to a local hospital for treatment of his injuries and released. The cell phone that recorded the incident was recovered.
Mohmand was charged with two counts of Assault 2nd Degree, Reckless Driving, Resisting Arrest, Aggravated Unlicensed Operator 3rd Degree and multiple Vehicle and Traffic Law violations. The defendant was arraigned on July 8, 2015 in First District Court in Hempstead.
The fact that a defendant has been charged with a crime is merely an accusation and the defendant is presumed innocent unless proven guilty. Defendants are entitled to a fair trial with the burden on the prosecution to prove guilt beyond a reasonable doubt.
