(Long Island, NY) The Second Squad reports the arrest of a Hicksville man on February 15, 2016 at 7:35 am for Criminal Possession of a Firearm that occurred in Hicksville.
According to detectives, on January 22, 2016, Michael Schmeltzer, 25, was in his bedroom with a male friend when the friend picked up a shotgun from the bed which he believed to be a BB gun. The weapon accidentally discharged, striking the defendant in the lower left leg. Schmeltzer was transported to an area hospital where he was admitted for treatment of his injury.

A subsequent investigation determined that the weapon was not legally purchased. Schmeltzer surrendered on Monday February 15, 2016 to Second Squad detectives in Woodbury.
Schmeltzer is charged with Criminal Possession of a Firearm and Criminal Possession of a Weapon 2nd degree. He will be arraigned on Monday February 15, 2016 at First District Court in Hempstead.
The fact that a defendant has been charged with a crime is merely an accusation and the defendant is presumed innocent unless proven guilty. Defendants are entitled to a fair trial with the burden on the prosecution to prove guilt beyond a reasonable doubt.
