(Long Island, NY) Third Squad detectives report the arrest for Criminal Possession of a Weapon which occurred on Monday, May 25, 2015 at 5:42 pm in Hempstead.
According to detectives, the owner of Billiards, located at 64 Wellington Street saw security enter the bathroom area to address a problem. The owner then went to the bathroom area, where she witnessed security remove a handgun from the defendant and escort him out of the establishment. The complainant called the Hempstead Police Department and reported the incident.

Detectives placed Herbert Soliz, 32, no known address under arrest when he returned in an attempt to retrieve the handgun. Upon further investigation it was discovered the defendant fired the gun into the air.
Soliz is charged with Criminal Possession of a Weapon 2nd degree and Reckless Endangerment 1st degree. He will be arraigned on Tuesday, May 26, 2015 in First District Court, Hempstead.
The fact that a defendant has been charged with a crime is merely an accusation and the defendant is presumed innocent unless proven guilty. Defendants are entitled to a fair trial with the burden on the prosecution to prove guilt beyond a reasonable doubt.
