(Long Island, NY) The Seventh Squad reports the details of an arrest for Robbery that occurred on Friday, May 29, 2015 at 8:10 pm in Wantagh.
According to detectives, five young boys between the ages of 13 and 16 were playing basketball on Duck Pond Drive and Dock Lane, when a male subject approached the group punched victim # 1 in the lip and demanded money and property.

A struggle ensued with the subject, victim # 1 and victim # 2, resulting in a cell phone falling to the ground. The subject then picked up the phone and fled the scene on foot. Victim # 2 gave chase and was able to stop the subject who then retrieved a glass bottle from his backpack and threaten to harm victim #2. The subject then continued to flee. Seventh Precinct officers responded to the scene and were able to apprehend and place under arrest Jairo Garcia, 17, of Levittown. The cell phone was recovered. The victims’ were treated at the scene for lacerations, swelling and pain.
Defendant Garcia is being charged with Robbery 1st Degree, Criminal Possession of a Weapon and 2 counts of Assault 3rd Degree. He was arraigned on Saturday, May 30, 2015 at First District Court, 99 Main Street, Hempstead.
The fact that a defendant has been charged with a crime is merely an accusation and the defendant is presumed innocent unless proven guilty. Defendants are entitled to a fair trial with the burden on the prosecution to prove guilt beyond a reasonable doubt.
