(Long Island, NY) First Squad detectives report the details of an arrest for an assault that occurred in Merrick on Tuesday, 09/01/15 at 11:50 A.M.
According to detectives, Timothy Burzynski, 26, of Merrick, while in his home shot a male victim, 31, with a pellet rifle from his window. The victim had been doing construction work across the street and the defendant was being disturbed by the noise. Police recovered the pellet gun in addition to seven other firearms and assorted ammunition.

Nassau County Police Ambulance transported the victim to a local hospital for treatment of a pellet gun wound to the upper back.
Burzynski is being charged with Assault 2nd Degree, Criminal Possession Weapon 4th Degree, Criminal Possession Weapon 3rd Degree and will be arraigned on Wednesday, 09/02/15 in First District Court, Hempstead.
The fact that a defendant has been charged with a crime is merely an accusation and the defendant is presumed innocent unless proven guilty. Defendants are entitled to a fair trial with the burden on the prosecution to prove guilt beyond a reasonable doubt.
