(Long Island, NY) The Seventh Precinct reports the arrest of a Merrick woman for driving while impaired on prescription drugs with her two children in the car (Leandra’s Law) in Merrick on Monday, April 11, 2016 at 1:43 P.M.
According to police officers, Kathryn Naccari, 37, of was operating a 2013 Honda Accord southbound on Babylon Rd., making a left turn onto Merrick Rd. when she was in collision with a 2010 GMC Arcade, travelling eastbound on Merrick Rd.

The defendant had her 4-year-old daughter and 2-year-old son in the vehicle, secured in car seats, at the time of the accident.
The female operator, 62, of the GMC was transported to a local hospital for back injuries. The children and the defendant did not sustain any injuries. The children were released to a family member at the scene.
Naccari is being charged with DWAI Drugs, two counts of Aggravated DWI-With a Child Passenger Less than 16 (Leandra’s Law) and two counts of Endangering the Welfare of a Child. She will be arraigned on Tuesday, April 12, 2016 in First District Court, Hempstead.
The fact that a defendant has been charged with a crime is merely an accusation and the defendant is presumed innocent unless proven guilty. Defendants are entitled to a fair trial with the burden on the prosecution to prove guilt beyond a reasonable doubt.
