(Long Island, NY) The Third Squad reports the arrest of Mineola man for a Burglary that occurred on Tuesday, September 1, 2015 at 5:15 p.m. in Mineola.
According to detectives, a female 64, heard noises in the basement of her 9th Avenue home and observed Jose Almendares, 35, in the basement. The victim fled the home and notified police. A Third Precinct officer along with a Sergeant responded to the residence and located Almendares hiding on the stairs leading from the basement to the main floor.

The defendant refused to comply with direct orders by the officers and a brief struggle ensued which caused one officer to suffer a fracture to his hand.
Almendares is charged with Burglary 1st degree, Assault 2nd degree and Resisting Arrest. He was arraigned on Wednesday, September 02, 2015 at First District Court in Hempstead.
The fact that a defendant has been charged with a crime is merely an accusation and the defendant is presumed innocent unless proven guilty. Defendants are entitled to a fair trial with the burden on the prosecution to prove guilt beyond a reasonable doubt.
