(Long Island, NY) The Seventh Squad reports the arrest of a Central Islip man for an Assault which occurred on Sunday, April 6, 2015 at 3:00 p.m. in Massapequa.
According to detectives, the defendant Jose L. Rodriguez, 28 of 5 Birchgrove Drive was being detained by store security for Petit Larceny at Wal-Mart located at 200 Sunrise Mall. Two Seventh Precinct detectives arrived at the security office on an unrelated investigation and informed the defendant he was under arrest. When the defendant’s wife and two children ages 2 and 4 arrived at the office they were informed by the detectives they had to leave. At that time Rodriguez attempted to exit the office with his family. Detectives advised the defendant to remain seated which he refused. A struggle ensued as the detectives attempted to place handcuffs on Rodriguez. As a result one of the detectives suffered an injury to his right hand and was transported to a local hospital for treatment. After Rodriguez was secured three forged documents were found on his possession.

Rodriguez is charged with Assault 2nd degree, Resisting Arrest, Endangering the Welfare of a Child, three counts of Possession of a Forged Instrument 2nd degree, and Petit Larceny. He will be arraigned on Monday, April 07, 2014 at First District Court in Hempstead.
The fact that a defendant has been charged with a crime is merely an accusation and the defendant is presumed innocent unless proven guilty. Defendants are entitled to a fair trial with the burden on the prosecution to prove guilt beyond a reasonable doubt.
