(Long Island, NY) The Fourth Squad reports the arrest of two men for two incidents that occurred at 6:55pm on Saturday, December 19, 2015 in Valley Stream.
According to Detectives, defendant Kirk D. McRae Jr., 31, of Brooklyn was involved in a verbal altercation with two female complainants while on line at register 11 located inside Walmart located a 77 Green Acres Road. The defendant was armed with a four inch black handled razor knife that he waved in the air, causing the complainants to fear for their safety. No injuries were reported.

As Police Officers were placing defendant McRae under arrest, he began to resist arrest by struggling with officers and then did forcefully rip off an officer’s baton and baton holder from his duty belt. As defendant McRae was being transported in the police car to the precinct for arrest processing he did cause a disturbance while in the rear seat and attacked an officer by biting him on his forearm. He was controlled and the transport was completed.
As officers were placing defendant McRae under arrest and walking him through Walmart to the outside, defendant Shane Marco Bingham, 20, of Queens Village began using his cellular telephone camera to video tape officers.
At 6:58pm defendant Bingham tried to get closer to the scene and was asked to step back, as he did a six inch gravity knife with a red handle was sticking partially out of his rear pants pocket. At that time, the defendant was advised that he was under arrest. Defendant Bingham did resist arrest by swinging his arms violently and kicking his legs to get away from officers. Due to this altercation Officers sustained a sprained elbow and sprained wrist.
Defendant Kirk D. McRae is charged with Menacing 2nd, Criminal Mischief 4th, Possession of a Dangerous Weapon 4th, Obstructing Governmental Administration 2nd and Resisting Arrest.
Defendant Shane Marco Bingham is charged with two counts of Assault 2nd, Criminal Mischief 3rd, Criminal Possession of a Weapon 4th and Resisting Arrest.
Both defendants were arraigned on Sunday, December 20, 2015 in First District Court located at 99 Main Street Hempstead.
The fact that a defendant has been charged with a crime is merely an accusation and the defendant is presumed innocent unless proven guilty. Defendants are entitled to a fair trial with the burden on the prosecution to prove guilt beyond a reasonable doubt.
