(Long Island, NY) The Public Information Office reports the arrest of a South Carolina man for DWI (Leandra’s Law) on Friday, January 22, 2016 at 2:55 am in Westbury.
According to police, Third Precinct Police observed the defendant Steve D. Marks, 35, of Ridgeland, SC operating a 2011 Ford Expedition west on Old Country Road with its headlamps off. Third Precinct Police made a New York Vehicle and Traffics stop in the vicinity of 111 Old Country Road and it was revealed that the defendant Steve D. Marks was operating a vehicle while under the influence of alcoholic beverage.

Additionally the defendant had his two sons’ ages 10 and 6 not properly restrained in the third row seats. His 14 year old daughter and his 14 year old niece sitting in the second row were also not properly restrained. There were 6 other passengers in the vehicle as well.
The defendant was placed into police custody without incident and the children were released to their mother and aunt who were passengers. No injuries were reported. The vehicle was impounded.
The fact that a defendant has been charged with a crime is merely an accusation and the defendant is presumed innocent unless proven guilty. Defendants are entitled to a fair trial with the burden on the prosecution to prove guilt beyond a reasonable doubt.
