(Long Island, NY) Assemblyman Michael Montesano (R,C,I-Glen Head) is co-sponsoring legislation to protect residents across the state against invasion of privacy. Assembly Bill 4368 would implement penalties against a person who intentionally videotapes recreational activities in a neighboring backyard.

“No one should feel threatened in the privacy of their own home or yard,” said Montesano. “It is important that families, especially those with small children, are protected from unwarranted or potentially dangerous video surveillance by a neighbor. Supporting this common- sense legislation would protect the rights of many New York residents and prevent further invasive incidents from happening.”

This legislation was passed in the Senate for two consecutive years.

(Long Island, NY) Narcotics/Vice Bureau detectives report the details of four arrests for possession of heroin that occurred in Levittown on Thursday, 05/25/15 at 10:35 P.M.

According to detectives, Narcotics/Vice detectives along with Bureau of Special Operations police officers, while conducting an investigation at at 2977  Hempstead Tpke. in the parking lot of CVS, approached a 2004 Honda Accord operated by Thomas Moscarella, 22, along occupants Anthony Guerra, 23, Nicole Norelius, 23, Jason Norelius, 18, all of Lindenhurst, when they observed a clear plastic bag on the front passenger floor of the vehicle containing 95 glassines of Heroin. All defendants were removed from the vehicle and placed under arrest.

All four defendants are each being charged with Criminal Possession Controlled Substance 3rd Degree. Guerra is additionally being charged with Criminal Sale Controlled Substance 3rd Degree. They will be arraigned on Friday, 05/29/15 in First District Court, Hempstead.

(Long Island, NY) First Squad detectives report the arrest of a Hempstead man for arson that occurred in Roosevelt on Thursday, 05/28/15 at 11:14 A.M.

According to detectives, Tyrone Kinard, 27, set a plastic bag containing clothing on fire on the front stoop of a residence on Gormley Ave. The fire then extended to the building causing damage to the front door, siding and soffit. The defendant had been involved in a verbal argument with the female victim, 25, who resides there, and took her debit card in addition to violating a Family Court Order of Protection.

No injuries were reported.

The couple met while Surozenski was stationed in San Diego and later enjoyed a small wedding ceremony in California. Because they were not able to celebrate with the majority of their family and friends, they applied for the Veterans Wedding Giveback.

(Long Island, NY) Suffolk County Police Seventh Squad detectives are investigating a motor vehicle crash that killed a motorist in Middle Island on Thursday, May 28.

A man was driving a 2004 Hyundai Santa Fe, apparently eastbound on E. Bartlett Road, when he failed to negotiate a turn in the road. The vehicle struck a utility support pole and went off the roadway into a wooded marshy area.

The vehicle flipped over onto its side. The driver was pronounced dead by a physician assistant from the Office of the Suffolk County Medical Examiner.

The identity of the driver is being withheld pending notification of family.

(Long Island, NY) Heather Leibowitz, Director of Environment New York today joined U.S. Environmental Protection Agency Regional Administrator Judith A. Enck, Mitchell J. Silver, FAICP, the Commissioner for NYC Parks, and Irene Scheid, the Executive Director at the Alley Pond Education Center, to mark progress of EPA-funded work to restore wetlands at Alley Pond, in Douglaston and Flushing, Queens.

Yesterday, the EPA and the U.S. Army Corps of Engineers issued an important national “Clean Water Rule,” which will protect streams and wetlands. Streams and wetlands provide many benefits to communities by reducing flooding, recharging groundwater supplies, filtering pollution, and providing habitat for fish and wildlife. Wetlands within urban areas are particularly valuable, as they can counteract the impacts of hard surfaces that don’t absorb rainwater or snowmelt.

“The Clean Water Rule will restore safeguards to 28,000 miles of waterways in New York and 20 million acres of wetlands across the country — an area the size of South Carolina and home to millions of birds and fish,” said Leibowitz. “That’s why yesterdays’ action is the biggest victory for clean water in a decade.”

“Wetlands provide enormous environmental benefits, from flood prevention to protecting water quality,” said EPA Regional Administrator Judith A. Enck. “With the EPA’s new national Clean Water Rule, now is the perfect time to spotlight the critical role wetlands play in protecting us from some of the worst effects of climate change, and in keeping our water clean. The outstanding work being done at Alley Pond is helping restore urban waterways that will be enjoyed for years to come.”

“NYC Parks manages more than 29,000 acres of parkland with over 10,000 acres of natural forest, woodland, freshwater wetland and salt marsh ecosystems,” said NYC Parks Commissioner Mitchell J. Silver, FAICP. “Through restoration projects like the ones happening at Alley Pond Park, our Natural Resources Group is committed to protecting our wetlands and ensuring long-term resilience of our open spaces.”

The court rulings had put small streams, headwaters and certain wetlands in a perilous legal limbo, allowing polluters and developers to dump into them or destroy them in many cases without a permit. In a four-year period following the decisions, the U.S. Environmental Protection Agency had to drop more than 1500 cases against polluters, according to one analysis by the New York Times.

First proposed in March 2014, the joint rule by EPA and the U.S. Army Corps of Engineers is backed by robust scientific review and has gained broad support across a wide range of constituencies. Mayors, brewers, kayakers, anglers, small businesses, and farmers joined a throng of citizens to submit more than 800,000 comments in favor of the rule last fall.

Environment New York, among those pushing for restored stream protections for the better part of the last decade, has gathered 65,000 comments from New Yorkers and held more than 100,000 face-to-face conversations about the need to close the loophole in the Clean Water Act in the past year alone.

Despite broad public support for restored clean water protections, oil and gas companies, developers, and other polluters have waged a bitter campaign against them. The U.S. House has passed multiple bills to block or severely weaken the rule, including one measure as recently as two weeks ago.

While yesterday’s action signaled the final chapter in the decade-long fight for small streams and headwaters, advocates warned today that U.S. Senate leaders were more determined than ever to use their authority derail the Clean Water Rule. Last Tuesday, a key subcommittee adopted a measure by Sen. John Barrasso (R-Wyo.) to thwart the rule. This summer, the Senate is likely to use the Congressional Review Act block the clean water protections, setting up a veto fight with the president.

“Yesterday the administration signed and sealed critical protections for our streams and wetlands,” said Leibowitz. “However, we need Senator Kirsten Gillibrand in New York to become a forceful advocate against polluters to make sure these clean water protections get delivered.”

AG Investigation Finds Alleged Violations Of Nutrient Runoff Law In 90% Of Walmart Stores Inspected; Run Off Lawn Fertilizer Containing Phosphorus Causes Algae Blooms That Foul Waterways, Harm Fish, Threaten Public Health

(Long Island, NY) Attorney General Eric T. Schneiderman today announced a settlement with Wal-Mart Stores, Inc. over alleged violations of a 2010 state law designed to reduce water pollution caused by excess phosphorus that runs off of  lawns  into New York waters. The Nutrient Runoff Law requires stores to display phosphorous-containing lawn fertilizers separately from those that are phosphorus-free, and post signs notifying consumers about the legal restrictions on using phosphorus-containing lawn fertilizer. An investigation by Attorney General Schneiderman’s Environmental Protection Bureau found that 90% of Walmart stores – 16 of 18 – inspected in New York displayed phosphorus-containing lawn fertilizers without the separation or signage required by the law.

“Clean and healthy water is a precious resource in our state, and one that my office and the law actively protect,” Attorney General Schneiderman said.  “In this case, the law requires retailers to help consumers avoid lawn fertilizers that can harm the public and our environment. We will continue to enforce the law and to keep New York safe today – and for future generations.”

According to Walmart’s company websites, there are over 200 Walmart and Sam’s Club stores (which are owned by Walmart) operating in New York. In July and August of 2014, the Attorney General’s Office inspected 18 Walmart stores across New York that sell fertilizer. At 16 of these stores, the office found that, in violation of the Nutrient Runoff Law, phosphorous-containing fertilizers were commingled with phosphorus-free fertilizers or displayed without the required signage, or both. Follow-up inspections at four Walmart stores, in September 2014, found additional alleged violations.

The 18 stores AG investigators visited were in Albany (2), Chautauqua (2), Erie (6), Nassau (3), Niagara (2), Rensselaer (1), Rockland (1), and Westchester (1) counties.

The settlement agreement requires Walmart to comply fully with the Nutrient Runoff Law and pay $98,000 in penalties to New York State for the alleged violations. The company has decided to comply with the law by halting sales of phosphorus-containing fertilizers intended for use on lawn or non-agricultural turf at Walmart stores and Sam’s Club stores in the state. Additionally, Walmart has decided not to sell phosphorous-containing fertilizers intended for use on lawn or agricultural turf over the internet (at Walmart.com) to consumers in New York.

Phosphorus is an element added to fertilizer to promote plant growth. While the soils in New York State typically contain enough phosphorus to support healthy lawns, homeowners and landscapers often apply phosphorus-containing fertilizers to lawns, and the excess phosphorus can then wash into our lakes, rivers, streams, and drinking water reservoirs. According to the New York State Department of Environmental Conservation, the use of phosphorus-containing fertilizers can double the amount of phosphorus washing off lawns. Once in the water, excess phosphorus causes rapid algae growth – known as algae blooms – which in turn can produce green slime on water bodies, as well as offensive odor and taste. In addition, algae blooms can deplete oxygen in the water that fish and other aquatic organisms need to survive. In some cases, these blooms produce toxins harmful to humans. In 2014 alone, DEC documented 92 harmful algae blooms in bodies of water across New York, many of which had toxins at levels high enough to cause serious health impacts including nausea, vomiting, skin, eye, and throat irritation, and allergic reactions or breathing difficulties.

According to DEC, phosphorus levels exceed state water quality standards in approximately 100 waters of the state – including reservoirs in the New York City drinking water watershed, Lake Champlain, Onondaga Lake, Chautauqua Lake, Greenwood Lake, and parts of Lake Ontario.  DEC has identified curbing excess phosphorus-containing fertilizer use on lawns as a key element of its plans to improve the health of many of these waters.

New York enacted the Nutrient Runoff Law specifically to reduce phosphorus runoff from non-agricultural sources. Among its provisions, the law applies to retailers who sell fertilizers that contain more than 0.67 percent phosphate, a form of phosphorus (for reasons involving the measurement of phosphorus in fertilizers, those containing less than 0.67% phosphate are referred to as “phosphorous free”).  The law requires retailers that sell phosphorus-containing fertilizers intended for use on lawns and other non-agricultural turfs to:

• display phosphorous-containing fertilizers separately from those containing 0.67 percent or less available phosphorus; and
• post a clearly-visible sign in the vicinity of phosphorus-containing fertilizers advising consumers about the harm phosphorus runoff has on water quality and the circumstances, under New York law, that phosphorus-containing fertilizer may be legally applied.

Under New York law, phosphorus-containing fertilizer may only be applied to lawn or non-agricultural turf when:

• A soil test indicates that additional phosphorus is needed for growth of that lawn or non-agricultural turf; or
• The fertilizer is used for newly established lawn or non-agricultural turf during the first growing season.

A retailer who sells phosphorous-containing fertilizers without complying with these requirements is subject to penalties of up to $500 for the first violation and up to $1,000 for each subsequent violation.

The Attorney General’s investigation of compliance with the Nutrient Runoff Law by other retailers is ongoing.
